These Terms of Service ("Terms") govern your access to and use of the services provided by Fourtree Marketing, a Maryland sole proprietorship ("Fourtree Marketing," "we," "us," or "our"). 2. Definitions

"Client"Any individual or business that purchases or uses our Services.
"Services"AI voice agents, chatbots, marketing automation, consulting, integrations, and related digital marketing services.
"AI Systems"Automated systems, models, workflows, scripts, and configurations using artificial intelligence or machine learning.
"Third-Party Platforms"External software such as GoHighLevel, telephony providers, SMS carriers, email platforms, and other integrations.
"Client Data"All data, content, contact lists, scripts, recordings, and materials provided by or on behalf of the Client.

3. Scope of Services

We provide AI-powered marketing and automation services designed to improve lead handling, customer communication, and operational efficiency. We do not guarantee specific revenue, conversion rates, or business outcomes.

All Services are provided on a best-efforts basis and may evolve as technology, platforms, or regulations change.

4. AI-Specific Services and Limitations

AI-based services are inherently probabilistic and may produce errors, unexpected outputs, or inconsistent results. You acknowledge and agree that:

  • AI systems do not replace human judgment
  • AI responses may be inaccurate, incomplete, or inappropriate
  • We do not guarantee accuracy, performance, or suitability for any particular purpose
  • AI systems rely heavily on the quality of Client-provided data
  • Fourtree Marketing is not responsible for decisions made based on AI-generated outputs

5. Client Responsibilities

You are solely responsible for:

  • The accuracy, legality, and ownership of all Client Data
  • Ensuring you have consent to use contact lists, phone numbers, and recordings
  • Reviewing AI scripts, automations, and workflows before deployment

You represent that all Client Data complies with applicable laws, including data protection and communication regulations.

6. Payment Terms

6.1 Fees

Fees may include one-time setup fees, monthly recurring service fees, and usage-based fees (e.g., calls, SMS, email). All fees are disclosed before service activation.

6.2 Billing

  • Monthly fees are billed in advance
  • Setup fees are non-refundable
  • Late or failed payments may result in suspension or termination of services

6.3 No Guarantee of Results

Payment is for access to Services, not guaranteed outcomes.

7. Refund Policy

Unless otherwise stated in writing: setup fees are non-refundable, monthly fees are non-refundable once a billing cycle begins, and no refunds are issued for unused time, usage credits, or early termination.

8. Intellectual Property

8.1 Our Intellectual Property

All AI systems, workflows, automations, templates, scripts, and methodologies developed by Fourtree Marketing remain our intellectual property.

8.2 Client License

We grant Clients a limited, non-transferable license to use deliverables solely during the active service period.

8.3 Client Data Ownership

Clients retain ownership of their data but grant us permission to use it solely to provide Services.

9. Data Privacy and Security

We take reasonable steps to protect Client Data but cannot guarantee absolute security. Clients acknowledge that data may pass through third-party platforms and that no system is completely secure. We are not liable for breaches beyond our reasonable control.

9.1 SMS / Text Message Services

Fourtree Marketing provides AI-powered communication services that include SMS messaging for the following purposes:

  • Responding to inbound service inquiries
  • Sending appointment booking links and confirmations
  • Providing service request updates and status notifications
  • Delivering requested business information
  • Sending appointment reminders

SMS messages are sent only in response to direct customer engagement through phone calls, web forms, or explicit requests for information. We do not send unsolicited promotional messages or share your contact information for third-party marketing.

9.2 SMS Opt-Out

You have the right to stop receiving text messages at any time. To opt out, reply to any message with one of the following:

9.3 Message and Data Rates

Standard message and data rates may apply. The number of messages you receive will vary based on your interaction and service requests. You are responsible for any charges from your mobile carrier.

9.4 Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on factors outside our control including carrier network, device compatibility, location, and network congestion.

9.5 Age Requirement

Our services, including SMS communications, are intended for users 18 years of age or older. By providing your phone number you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

10. Third-Party Integrations

Our Services rely on Third-Party Platforms such as GoHighLevel, telephone carriers, and email/SMS providers. We are not responsible for downtime or outages caused by third parties, changes to third-party pricing or features, or account suspensions imposed by third parties.

11. Service Levels and Uptime

We do not guarantee uninterrupted service. Planned maintenance, third-party outages, and force majeure events may cause downtime. Service credits are not provided unless explicitly agreed in writing.

12. Compliance with Communication Laws

Clients are solely responsible for compliance with:

  • TCPA (Telephone Consumer Protection Act)
  • A2P 10DLC regulations
  • CAN-SPAM Act
  • State and federal telemarketing laws

Clients must ensure proper opt-in, opt-out, and recordkeeping practices. We are not liable for Client non-compliance.

13. Indemnification

You agree to indemnify and hold harmless Fourtree Marketing from any claims, damages, fines, or legal fees arising from your use of the Services, Client Data violations, communication law violations, or misuse of AI systems.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount paid by you in the prior 30 days. This limitation applies even if AI systems malfunction or produce incorrect outputs.

15. Termination

Either party may terminate services with written notice. We may immediately terminate or suspend services for non-payment, legal violations, abuse of systems, or risk to platforms or carriers. All outstanding balances remain due upon termination.

16. Dispute Resolution and Arbitration

Any dispute shall be resolved by binding arbitration in Maryland, unless prohibited by law. You waive the right to participate in class actions or jury trials.

17. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law principles.

18. Changes to Terms

We may update these Terms at any time. Continued use of Services constitutes acceptance of revised Terms.
